ESTATEMENTS TERMS & CONDITIONS
OLD SECOND NATIONAL BANK ESTATEMENTS CONSENT AND DISCLOSURE AGREEMENTWelcome to Old Second National Bank's eStatements Delivery Service which provides you with an easy and convenient way to access your periodic Bank Statement. This agreement ("Agreement"), made between you and Old Second National Bank ("Bank") for the purpose of receiving an electronic version of your account statement online, governs the terms of use of the Bank's eStatement Delivery Service, and is an extension of your Online Banking Services Agreement.
The same terms apply with respect to eStatements as for those delivered in paper form, and the deposit agreements and disclosures that you have previously entered into with or received from the Bank remain in effect.
The Bank's eStatements Service is available to you at no cost.
CONSENT FOR ELECTRONIC DELIVERYFor the Bank to begin providing your Bank Statements to you electronically, we need your consent. Your consent, which will be given by selecting "I AGREE", is to authorize the Bank to provide to you your periodic Bank Statements electronically including any other disclosures and legal notices that relate to your account(s). If your Old Second National Bank account is jointly owned with another person(s), any one signer may consent to receive electronic disclosures and access eStatements and notices. That person's election to access eStatements shall then apply to all of you.
EMAIL ADDRESSThe Bank will send an email to your primary email address notifying you that your eStatement is ready to view on the Bank's O2 Online Banking webpage. You agree to notify us promptly in writing by letter sent via U.S. Mail, by email, or by phone of any changes to your email address(s) or any errors or complications relating to electronic access of your Bank Statements.

If you have not notified us in writing of any change to your email address, you agree that your failure to provide us with a good email address is lack of ordinary care on your part. If we become aware that you are not receiving your eStatement(s) and our attempts to contact you have failed, we will send your Statement(s) to you via U.S. Mail to your last address known to us.
If you have a "multiple-party account", your email address may be changed using the procedure described above by any authorized party to your account. THE BANK SHALL HAVE NO OBLIGATION OR LIABILITY TO ANY OF THE PARTIES TO A MULTIPLE-PARTY ACCOUNT IF THE EMAIL ADDRESS IS CHANGED USING THE PROCEDURES SET FORTH ABOVE.
ELIGIBLE ACCOUNTSThe Bank's eStatements Service is available for all Personal and Business statement accounts. Old Second National Bank reserves the right to determine from time to time which accounts may be eligible as an eStatement.
You may elect to receive your periodic statement online for all or selected eligible account(s). Each account must be activated for the service on an individual basis, and will be available at the same frequency as your statement was previously mailed. To enroll your account(s) for eStatement access, simply log into the Old Second Bank's O2 Online Banking Service and click on the "eStatements" tab. You may choose the electronic statement for each account that you would like to access through eStatements. All future eStatements will be accessible by clicking on the "eStatements" tab within your O2 Online Banking access. eStatements will be viewable electronically in "Adobe Flash" and downloadable in Portable Document Format ("PDF") that you can view online, download or print at your convenience.
ACCESSING YOUR ESTATEMENTOnce enrolled in the Service, you will be able to view up to 16 cycles of statement history. Information prior to registration will not be available online. Access to history may vary by account type. All statements are in a format that can be printed or saved to your hard drive. If you elect to receive your Bank Statements through electronic delivery, the Bank will no longer send you your statements through the mail. To obtain a paper copy of a particular bank statement, please contact the Bank. Our normal statement copy and research fee will apply.
If you close your account or cancel the Service, you will no longer be able to view your account statements online. Before canceling the Service or closing your account, print or electronically save copies of your eStatements for your records. You still have a right to request a paper copy of any bank statement, disclosure or notice.
REVIEW OF PERIODIC STATEMENTYou must promptly access and review your eStatement and any accompanying items and notify us in writing immediately of any error, unauthorized transaction, or any other irregularity. If you allow someone else to access your statement, you are still fully responsible to review the statement for any errors, unauthorized transactions, or any other irregularities. Any applicable time periods within which you must notify us of any errors on your account statement(s) shall begin on the eStatement email notification date regardless of when you access and/or review your eStatement. If you do not immediately report to Old Second National Bank any non-receipt of eStatements or any error, irregularity, discrepancies, claims or unauthorized debits or items, you shall be deemed conclusively to have accepted all matters contained in the eStatements to be true, accurate and correct in all respects.

CHANGE STATEMENT DELIVERY METHODYour consent to receive Account Statements electronically is voluntary and may be withdrawn at any time. If you would like to discontinue the service, please contact us with your request of change. It may take up to 45 days for the Bank to implement your request, and your account may be subject to a monthly paper statement fee. A list of fees can be found with your account documentation provided at the time the account was opened or on our website at www.oldsecond.com. You will automatically receive your statements in paper form via postal mail service. Statements that were previously presented online will not be mailed to you and you will not be able to access them online once your eStatement service is canceled. However, you can order copies of past statements by contacting the Bank. Normal statement copy and research fees will apply.
SYSTEM REQUIREMENTSYou are responsible for and must provide all equipment, software and services necessary to access the Service at your own expense. In order to use the Service and to access, receive and retain information electronically, your system must have:
- Old Second Online Banking Service
- Standard PC or Mac (Pentium IV/1 GHz processor or higher/64 Mb RAM or greater).
- Microsoft® Windows XP/Vista/Windows 7 or Mac OS-X.
- Cable, DSL or ISDN equivalent or better internet connection
- Security, anti-virus and Spyware updates applied
- A valid email address
- Adobe® Flash Player version 8.0 or greater is required to view and or print documents in the dynamic statement renderer
- Adobe® Acrobat Reader – you can download the latest Adobe Acrobat Reader free of charge at www.adobe.com
We will give you notice of any change to the hardware and software requirements if the change will adversely affect your ability to access, receive, and retain eStatements, disclosures and legal notices.
TERMINATIONThis Agreement shall remain in full force and effect from the day your enrollment is submitted by you and accepted by the Bank and at all times while you are using the Service. After you have activated this Service, either party can terminate the Agreement upon thirty (30) days prior written notice to the other party. We also have the right to terminate this agreement immediately, with or without cause, or if you fail to comply with the terms of this agreement or any other agreement which you may have with us or any applicable rule or regulation which may govern your account(s). If we terminate this Agreement for any of these reasons, such termination shall be effective on the effective date specified in a written notice mailed to you, and not on the date when the notice is mailed or received. Any amendment or revision to this Agreement must be executed in writing by an authorized party to your account and attached to our copy of the Agreement as well as noted in our account records.
CHANGE IN TERMSThe Bank reserves the right to modify this agreement at any time. You will be notified as soon as possible when any changes are made that materially affect your rights. Notifications will either be mailed under separate cover or delivered to you online.
PRIVACYAll information gathered from you in connection with using this Service will be governed by Old Second National Bank's Privacy Policy. A copy of our Privacy Policy can be found on the eStatements page by clicking the Policy tab.
INTERNET SECURITYWe will use commercially reasonable measures, consistent with industry standards, to maintain a reasonable level of security over the information contained in the electronically delivered account statement(s) and notices. To provide the highest level of security, data is stored encrypted in a secure website delivered and translated over the internet. Our online forms require using a supported browser and is password protected for access to the data on the eStatements website.
