eStatements Terms & Conditions
OLD SECOND NATIONAL BANK ESTATEMENTS CONSENT AND DISCLOSURE AGREEMENT
The same terms apply with respect to eStatements as for those delivered in paper form, and the deposit agreements and disclosures that you have previously entered into with or received from the Bank remain in effect.
The Bank's eStatements Service is available to you at no cost.
Consent for Electronic Delivery
For the Bank to begin providing your Bank Statements to you electronically, we need your consent. Your consent, which will be given by selecting "I AGREE", is to authorize the Bank to provide to you your periodic Bank Statements electronically including any other disclosures and legal notices that relate to your account(s). If your Old Second National Bank account is jointly owned with another person(s), any one signer may consent to receive electronic disclosures and access eStatements and notices. That person's election to access eStatements shall then apply to all of you.
The Bank will send an email to your primary email address notifying you that your eStatement is ready to view on the Bank's O2 Online Banking webpage. You agree to notify us promptly in writing by letter sent via U.S. Mail, by email, or by phone of any changes to your email address(s) or any errors or complications relating to electronic access of your Bank Statements.

If you have not notified us in writing of any change to your email address, you agree that your failure to provide us with a good email address is lack of ordinary care on your part. If we become aware that you are not receiving your eStatement(s) and our attempts to contact you have failed, we will send your Statement(s) to you via U.S. Mail to your last address known to us.
If you have a "multiple-party account", your email address may be changed using the procedure described above by any authorized party to your account. THE BANK SHALL HAVE NO OBLIGATION OR LIABILITY TO ANY OF THE PARTIES TO A MULTIPLE-PARTY ACCOUNT IF THE EMAIL ADDRESS IS CHANGED USING THE PROCEDURES SET FORTH ABOVE.
The Bank's eStatements Service is available for all Personal and Business statement accounts. Old Second National Bank reserves the right to determine from time to time which accounts may be eligible as an eStatement.
You may elect to receive your periodic statement online for all or selected eligible account(s). Each account must be activated for the service on an individual basis, and will be available at the same frequency as your statement was previously mailed. To enroll your account(s) for eStatement access, simply log into the Old Second Bank's O2 Online Banking Service and click on the "eStatements" tab. You may choose the electronic statement for each account that you would like to access through eStatements. All future eStatements will be accessible by clicking on the "eStatements" tab within your O2 Online Banking access. eStatements will be viewable electronically in "Adobe Flash" and downloadable in Portable Document Format ("PDF") that you can view online, download or print at your convenience.
Accessing your eStatement
Once enrolled in the Service, you will be able to view up to 16 cycles of statement history. Information prior to registration will not be available online. Access to history may vary by account type. All statements are in a format that can be printed or saved to your hard drive. If you elect to receive your Bank Statements through electronic delivery, the Bank will no longer send you your statements through the mail. To obtain a paper copy of a particular bank statement, please contact the Bank. Our normal statement copy and research fee will apply.
If you close your account or cancel the Service, you will no longer be able to view your account statements online. Before canceling the Service or closing your account, print or electronically save copies of your eStatements for your records. You still have a right to request a paper copy of any bank statement, disclosure or notice.
Review of Periodic Statement
You must promptly access and review your eStatement and any accompanying items and notify us in writing immediately of any error, unauthorized transaction, or any other irregularity. If you allow someone else to access your statement, you are still fully responsible to review the statement for any errors, unauthorized transactions, or any other irregularities. Any applicable time periods within which you must notify us of any errors on your account statement(s) shall begin on the eStatement email notification date regardless of when you access and/or review your eStatement. If you do not immediately report to Old Second National Bank any non-receipt of eStatements or any error, irregularity, discrepancies, claims or unauthorized debits or items, you shall be deemed conclusively to have accepted all matters contained in the eStatements to be true, accurate and correct in all respects.

Change Statement Delivery Method
Your consent to receive Account Statements electronically is voluntary and may be withdrawn at any time. If you would like to discontinue the service, please contact us with your request of change. It may take up to 45 days for the Bank to implement your request, and there is no charge for discontinuing the Service. You will automatically receive your statements in paper form via postal mail service. Statements that were previously presented online will not be mailed to you and you will not be able to access them online once your eStatement service is canceled. However, you can order copies of past statements by contacting the Bank. Normal statement copy and research fees will apply.
You are responsible for and must provide all equipment, software and services necessary to access the Service at your own expense. In order to use the Service and to access, receive and retain information electronically, your system must have:
- Old Second Online Banking Service
- Standard PC or Mac (Pentium IV/1 GHz processor or higher/64 Mb RAM or greater).
- Microsoft® Windows XP/Vista/Windows 7 or Mac OS-X.
- Cable, DSL or ISDN equivalent or better internet connection
- Security, anti-virus and Spyware updates applied
- A valid email address
- Adobe® Flash Player version 8.0 or greater is required to view and or print documents in the dynamic statement renderer
- Adobe® Acrobat Reader – you can download the latest Adobe Acrobat Reader free of charge at www.adobe.com
- One of the following browsers listed:
We will give you notice of any change to the hardware and software requirements if the change will adversely affect your ability to access, receive, and retain eStatements, disclosures and legal notices.
This Agreement shall remain in full force and effect from the day your enrollment is submitted by you and accepted by the Bank and at all times while you are using the Service. After you have activated this Service, either party can terminate the Agreement upon thirty (30) days prior written notice to the other party. We also have the right to terminate this agreement immediately, with or without cause, or if you fail to comply with the terms of this agreement or any other agreement which you may have with us or any applicable rule or regulation which may govern your account(s). If we terminate this Agreement for any of these reasons, such termination shall be effective on the effective date specified in a written notice mailed to you, and not on the date when the notice is mailed or received. Any amendment or revision to this Agreement must be executed in writing by an authorized party to your account and attached to our copy of the Agreement as well as noted in our account records.
Change in Terms
The Bank reserves the right to modify this agreement at any time. You will be notified as soon as possible when any changes are made that materially affect your rights. Notifications will either be mailed under separate cover or delivered to you online.
We will use commercially reasonable measures, consistent with industry standards, to maintain a reasonable level of security over the information contained in the electronically delivered account statement(s) and notices. To provide the highest level of security, data is stored encrypted in a secure website delivered and translated over the internet via 128 bit encryption. Our online forms require using a browser that supports 128 bit encryption and is password protected for access to the data on the eStatements website.
YOU UNDERSTAND THAT THESE INDUSTRY STANDARDS ARE DYNAMIC AND CONSTANTLY DEVELOPING. BY ENROLLING IN THE ESTATEMENTS SERVICE, YOU ACKNOWLEDGE AND UNDERSTAND THAT THERE ARE RISKS TO ELECTRONIC DELIVERY OF ACCOUNT STATEMENT(S) AND NOTICES, INCLUDING, BUT NOT LIMITED TO, DELAY OR FAILURE OF DELIVERY DUE TO TECHNICAL DIFFICULTIES, WEATHER CONDITIONS (INCLUDING BUT NOT LIMITED TO SUN SPOTS), MATTERS BEYOND OUR REASONABLE CONTROL OR INTERCEPTION AND/OR ALTERATON OF SUCH ACCOUNT STATEMENT(S) AND NOTICES BY THIRD PARTIES IN SPITE OF THE BANK'S COMMERCIALLY REASONABLE SECURITY MEASURES. BY ENROLLING IN ESTATEMENTS, YOU REPRESENT THAT YOU HAVE CONSIDERED OUR SECURITY MEASURES AND FIND THAT OUR SECURITY MEASURES ARE COMMERCIALLY REASONABLE. IN REACHING THIS CONCLUSION, YOU HAVE CONSIDERED THE HISTORICAL AND POTENTIAL FUTURE CONTENT OF YOUR ACCOUNT STATEMENT(S), THE RISKS ASSOCIATED WITH ELECTRONIC DELIVERY OF ACCOUNT STATEMENT(S) AND OUR SECURITY PROCEDURES. IF YOU CONCLUDE THAT OUR SECURITY PROCEDURES CEASE TO BE COMMERCIALLY REASONABLE IN THE FUTURE, YOU MUST TERMINATE THIS AGREEMENT IMMEDIATELY IN ACCORDANCE WITH THE TERMINATION SECTION.
Protecting Your Login ID
You are responsible for the confidentiality of your Online Banking ID and Password, and are bound by the same rules that govern the security of your Online Banking credentials as defined in your O2 Online Banking Services Agreement. If you suspect that your Online Banking credentials have been compromised, contact us immediately.
No Warranty for Continuous or Uninterrupted Service
Because of the unpredictability of the Internet, we do not guarantee continuous or uninterrupted access to your bank statements through the Internet. However, should you be unable to access your statements, you can contact us and the Bank will take other measures to provide copies of your statements to you.
You agree to waive and release any claims against Old Second National Bank arising out of or in any way related to the eStatement service, except for those claims resulting solely from the negligent acts or omissions of the Bank. All questions regarding your eStatements access should be directed to Old Second National Bank, during business hours, at 877-866-0202. You may also email us at email@example.com providing account name and email address.
This Agreement shall be governed by and constructed in accordance with the laws of the State of Illinois and any applicable Federal laws and regulations. You irrevocably submit to the jurisdiction of any Federal or State court sitting in the State of Illinois for any action that you bring and agree that, in any action brought under this Agreement, venue shall be placed in Kane County, Illinois. A determination that any part of this Agreement is invalid or unenforceable will not affect the remainder of this Agreement.
The NetStatement service is separate from the eStatement service and allows you to receive your account statements in a PDF format via e-mail. We will send your periodic account statement(s) to the e-mail address provided by you. You agree to notify us promptly in writing by letter sent via U.S. Mail, by e-mail, or by phone of any changes to your e-mail address(es). We will verify your identity against information you have provided on your enrollment form. If you have not notified us in writing of any change to your e-mail address, you agree that your failure to provide us with a good e-mail address is the lack of ordinary care on your part. If we become aware that you are not receiving your NetStatement(s) and Notices, and our attempts to contact you have failed, we will send your Statement(s) and notice(s) to you via U.S Mail to your last address known to us.
You must choose a NetStatement PIN for each e-mail address the statements are delivered to. This PIN is used to open your account statement and should be stored in a safe place.
If you would like to change your password, you must notify us in writing, by calling toll free 877-866-0202 or by e-mail sent via address on file to request the password change. For your protection and for security purposes, we will not accept any change of password notices via e-mail or telephone. The procedure for changing your current password is to simply set forth in a letter your current password, which we will then verify, and clearly set forth your new password. We will notify you via e-mail to verify the change to your new password. You are responsible to remember your password.
If you have a "multiple-party account", your e-mail address may be changed using the procedure described above by any authorized party to your account. THE BANK SHALL HAVE NO OBLIGATION OR LIABILITY TO ANY OF THE PARTIES TO A MULTIPLE-PARTY ACCOUNT IF THE E-MAIL ADDRESS IS CHANGED USING THE PROCEDURES SET FORTH ABOVE.
Acceptance and Consent
By selecting "I AGREE" and submitting your request, you are enrolling in the eStatements Service. You affirmatively consent to receive, and acknowledge that you can receive, access and retain all eStatements and other disclosures and legal notices. You understand that by enrolling in the Service, you will no longer receive statements by mail on the eligible account(s) for which you have enrolled. You acknowledge that you accept and understand the terms of this Agreement and that your computer system meets the minimum system requirements described in this Agreement.
If you do not select "I AGREE," you will not be enrolled in the Service and will not be bound by this Agreement.
